1. Introduction and Acceptance
These Terms and Conditions govern the use of services provided by Emlumja (Pty) Ltd, trading as Careerless But Fearless and Pivot Fearlessly (“the Company”). By purchasing a package or completing a diagnostic audit, you (“the Client”) agree to be bound by these terms.
2. Nature of Service
The Client acknowledges that the Company provides career guidance and occupational mapping reports based on proprietary data-driven diagnostics.
- Not a Guarantee: While our reports are engineered for high-precision career vectoring, the Company does not guarantee specific employment outcomes, salary increases, or university admissions.
- Consultative Only: Our reports are for informational and advisory purposes. Final career or educational decisions remain the sole responsibility of the Client.
3. Data Collection and POPIA Compliance
In accordance with the Protection of Personal Information Act (POPIA):
- Purpose: Data collected via our diagnostic audits is used solely to generate the Client’s custom report.
- Consent: By completing an audit, the Client (or legal guardian in the case of a minor) expressly consents to the processing of sensitive personal information, including educational history, self-stated preferences, and professional ambitions.
- Security: We implement industry-standard encryption to protect your “Diagnostic Vector.” We will never sell your data to third parties.
4. Minors and Guardianship
For the “Future Mapping” (Student) packages:
- The Purchaser confirms they are the legal guardian of the student or have obtained express written consent from a legal guardian to proceed with the diagnostic.
- All data pertaining to minors is handled with the highest level of statutory protection.
5. Payment and Refund Policy
- Commitment: Due to the personalised, digital, and analytical nature of our reports, all sales are final once the diagnostic audit has been accessed or started.
- Exclusions: Refunds will not be issued for “change of mind” or if the Client disagrees with the findings of the data-driven report.
6. Intellectual Property
The methodology, branding, and “Fearless” diagnostic frameworks are the exclusive intellectual property of the Company. Reports are for the personal use of the Client and may not be resold, redistributed, or used for commercial coaching purposes without express written consent.
7. Limitation of Liability
To the maximum extent permitted by South African law, the Company shall not be liable for any indirect, consequential, or incidental damages arising from the implementation of the advice contained within a report.
